PILLAR ATHLETICS, LLC – TERMS OF SERVICE

1. Introduction

Welcome to PILLAR ATHLETICS, LLC (“PILLAR,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of our website, wholesale portal, online store, and any purchase of products (“Goods”) from PILLAR.

By using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.


2. Definitions

Company / PILLAR: PILLAR ATHLETICS, LLC
Service: Website, wholesale portal, online store, or any related platform
Goods: Apparel and merchandise offered for sale
Order: A request to purchase Goods from PILLAR
Wholesale Buyer: Any business purchasing Goods for resale
Affiliate: Any entity under common control with PILLAR


3. Eligibility

You must be at least 18 years old (or 13+ with parental consent) to use our Service. By using our Service, you confirm that you meet this requirement.


4. Wholesale Terms – Payment, Interest & Collections

Payment Terms
All wholesale invoices are due upon shipment unless otherwise agreed in writing.

Late Fees & Interest
Any unpaid invoice after 30 days will incur 15% interest per month on the outstanding balance.

Collections
Invoices unpaid after 60 days may be sent to a collections agency.
Buyers are responsible for all associated fees, including legal and collection costs.
PILLAR reserves the right to suspend future orders for accounts past due.


5. Placing Orders

By placing an Order, you warrant that:

  • You are legally authorized to enter into binding contracts

  • All billing, payment, and shipping information provided is accurate and complete


6. Shipping & Address Accuracy

PILLAR provides an order summary at the time of order creation, including shipping address.

Buyers must review and confirm all shipping details before shipment.

Failure to update an address before shipping means the buyer assumes full responsibility for lost, delayed, or misdelivered orders.

No refunds or credits will be issued for incorrectly shipped orders.

Replacement orders are charged in full, including shipping and handling fees.

Returned shipments due to incorrect addresses are the buyer’s responsibility.


7. Pricing & Availability

Prices and product availability are subject to change without notice.

PILLAR reserves the right to correct any errors, inaccuracies, or omissions at any time.


7A. Print & Embroidery Services (Third-Party Production)

  1. Third-Party Vendors
    PILLAR uses independent third-party print and embroidery providers for all customization services. Production timelines, costs, and quality-control measures are subject to the policies and capabilities of these vendors.

  2. Quoted Pricing & Adjustments
    Pricing for print and embroidery is provided to the customer upfront based on information available at the time of quoting.
    However, all quoted pricing is subject to change if additional print passes, corrective work, or materials are required to achieve acceptable quality.

    • Additional production costs incurred during the process are the customer’s responsibility.

    • PILLAR will make reasonable efforts to notify the customer of additional charges, but production may continue without prior notice when necessary to maintain quality or meet deadlines.

  3. Pricing Sheets
    Standard pricing sheets for print and embroidery are provided before production begins. These sheets are for reference only and do not limit PILLAR’s ability to bill for additional labor, corrective work, or materials needed during production.

  4. Customer Responsibility for Additional Costs
    By placing an order involving print or embroidery, the customer acknowledges that final costs may differ from initial estimates and agrees to pay any additional charges required to achieve the expected print or embroidery quality.

  5. Payment Terms & Collections for Print Services
    All invoices related to print or embroidery services are due upon receipt unless otherwise stated.

    • Balances unpaid after 30 days may be subject to collection efforts.

    • Customers are responsible for all costs associated with collection, including reasonable attorney’s fees, administrative fees, and any applicable interest.

    • PILLAR reserves the right to withhold, delay, or cancel future orders until all outstanding amounts are paid in full.


8. Returns & Cancellations

All returns must comply with our Return Policy.

Orders may be canceled by PILLAR due to product availability, pricing errors, suspected fraud, or incomplete payment authorization.


9. Prohibited Use & Content

You may not use our Service to transmit:

  • Fraudulent or defamatory content

  • Obscene, hateful, or discriminatory material

  • Malware, viruses, worms, or harmful code

  • Unlawful products, services, or promotions

  • Protected personal health information (HIPAA-regulated data)


10. Feedback

Any feedback submitted to PILLAR becomes our property.
PILLAR may use, reproduce, or distribute feedback without restriction or compensation.


11. Links to Third-Party Sites

PILLAR is not responsible for third-party websites linked through our Service.
Accessing these sites is at your own risk.


12. Termination

We may suspend or terminate your access at any time for violations of these Terms or for any other reason.


13. Limitation of Liability

To the fullest extent permitted by law, PILLAR is not liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits, data, or business interruption

  • Service availability issues

  • Third-party software, carriers, or service failures


14. “As Is” Disclaimer

All Goods and services are provided “AS IS” and “AS AVAILABLE” without warranties, except as required by law.


15. Governing Law

These Terms are governed by the laws of Arizona, without regard to conflicts of law.


16. Dispute Resolution – Binding Arbitration

All disputes must be resolved through binding arbitration under AAA Commercial Arbitration Rules.
Class actions and jury trials are waived.
Arbitration provisions survive termination of these Terms.


17. Severability & Waiver

If any part of these Terms is unenforceable, the remainder remains in effect.
Failure to enforce a right does not constitute a waiver of that right.


18. Changes to Terms

We may update these Terms at any time.
Continued use of the Service constitutes acceptance of revised Terms.
